From how to become a member to making a booking, here is everything you need to know about The Peaks.

Membership

By installing, accessing and/or using our Website or Services, you agree to these Terms. If you do not agree with these Terms, you must stop using the Website and Services.

You must provide a real and valid email and mobile phone number that belongs to you to signup for a membership. If you change your mobile phone number, email and/or address, you must update your information via the Website.

We reserve the right to adjust pricing at any time, including introducing an initial joining and/or re-activation fee. If you do not terminate your membership, you agree to the adjusted fees.

Even if you do not use your membership, you will be responsible for the membership fees until you terminate your membership, or it is otherwise terminated.

Any increase in VAT, other sales or indirect taxes which may be due or introduced as a result of changes to Federal Law that are payable on payments under these Terms, The Peaks reserves the right to collect these taxes from the Member.

If a fee is introduced, all membership yearly payments are final. No refunds will be given in respect of the Membership Fee, following termination of your Membership.

We may, at our sole discretion, verify your identity prior to processing a purchase. We may also refuse to process, or may cancel a purchase, as reasonably deemed necessary, to comply with applicable law or to respond to a case of misrepresentation, fraud or known or potential violations of the law or these Terms of Sale. Refunds for cancelled orders may be issued where appropriate in accordance with these terms and conditions of sale. Subject to any applicable laws, full refunds or partial refunds of memberships purchased is not permitted for any reason whatsoever.

When you attempt to purchase a membership or carry out any purchase/transaction on our website by purchasing a yearly membership, this constitutes an offer to buy the membership and/or complete the purchase/transaction. Your purchase is not complete until we email you to confirm the transaction. We reserve the right to reject your offer and not conclude a sale agreement with you.

You may only pay for products purchased on our Website using a valid credit or debit card.

In no event will the company, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your purchase or use, or inability to use, any product or membership, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

Any cause of action or claim you may have arising out of or relating to these terms of sale must be commenced within one (1) month after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

Bookings through The Peaks are not valid in conjunction with any other discount offer, promotion, special menu item or loyalty/reward program.

Booking

“Member” means any person who visits, uses or signs up to the website;

The Peaks can be contacted through our contact page.

Please read our T&Cs carefully as they set out our respective rights and obligations. The Peaks acts as a platform for the hotels, giving members the opportunity to be introduced to our hotels.

When you make a booking, you enter into a contract with the hotel, via The Peaks, not with The Peaks itself hence, we will not be liable, and neither will The Peaks deal with complaints in relation to the hotel itself. The hotel’s terms & conditions will apply to your booking – please read these for further clarifications.

General

The Peaks owns or has a licence to use all rights, title and interest in and to the website
By visiting and using The Peaks you warrant that you are 18 years old or above and have the right, authority and capacity to enter into and be bound by these Terms
When a member makes a booking, they are confirming they have read the terms and conditions for The Peaks and therefore are bound by them. Member bookings also confirm they have confirmed their consent, in accordance with our Privacy Policy
There is a limit of one account per household
In the event that The Peaks thinks that you are making any illegal and/or unauthorised use of the website, and/or the member breaches the terms, The Peaks reserves the right to take any action that it deems necessary, including terminating members use of the website and instigating legal proceedings
The Peak’s responsibility is to act as a members club offering value adds to your trip. We are not travel agents/sales agents. We introduce our members to hotels and hold no responsibility for anything after the introduction to the hotel including personal injury, death etc. We will also not be responsible to offer refunds/compensation in the case of unforeseen circumstances out of the hotel’s control. This includes but is not limited to war/threat of war/civil war, terrorist activity, riots, political unrest, chemical or biological disaster.
The Peaks may suspend the website at any time and for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension. The Peaks also reserves the right to make any changes to the website or to stop working with any hotel/brand partners without informing the members. Please contact your foreign office for advice prior to travel.
The Peaks may be linked to other websites, mostly through the form of features online and social channels. You must not establish a link to The Peaks in any website that is not owned by you/you do not represent. The Peaks reserves the right to withdraw linking permission without notice.
You must not attempt to gain unauthorised access to The Peaks, the server on which the website is stored or any server, computer or database connected to the website.
The names on the member’s account will need to match the booking name plus the member’s passport – members will not be able to make bookings for other people and hotels reserve the right to cancel bookings on arrival if the passport holder is not present and staying.
Cancellations/booking amendments can be done through the hotel directly but The Peaks must be alerted of any changes. These changes must be in-line with the hotel’s T&Cs.
Where necessary, refunds will be made directly from the hotel to the member
If the hotel needs to make a change/cancellation to your booking, they will contact both the member and The Peaks directly
The Peaks reserves the right to amend advertised prices at any time

Membership Sign-up & Use

In order to sign up to The Peaks, new members will be required to register and share personal details (email address, address, phone number, password)
Members are responsible for maintaining the confidentiality of their own password and account for all activities that occur under the account. If members know or suspect of anyone knowing their account details, The Peaks should be notified via the contact page
Signing up to be a member of The Peaks entitles members to receive newsletters and ‘Sneak Peaks’ deals
The Peaks reserves the right to disable accounts if members have failed to comply with any of the provisions of these Terms
Memberships will be valid for one year only

Complaints

The Peaks is not responsible for any complaints in relation to the hotel, Peaks Perks partners or Peaks Plans recommendations – The Peaks is only responsible for complaints that relate to the website. If members have a problem during their stay, this must be reported to the hotel as soon as possible
The Peaks does not accept responsibility for dealing with complaints. We are also not liable for refunds or compensation

Payment

All bookings will be done through the hotel – The Peaks will not store any credit card details and will not be liable for any payment discrepancies. The Peaks will act as a middle-man/introduction between member and hotels/brands etc. When members are ready to make a booking, they will be directed to the reservations team of the chosen hotel to secure the booking/make the payment. This method will also apply for the ‘Sneak Peaks’.
Your booking is confirmed and a contract between you and the hotel will exist when the confirmation has been received from the hotel.
The names on the member’s account will need to match the booking name plus the member’s passport. Passports will need to be shown on arrival to the hotel.
Payments are taken by hotels in the hotel's local/preferred currency and may be subject to exchange-rate changes and charges from your bank. The Peaks is not liable for these changes/charges.
As a booking platform only, we have no responsibility for any errors in any documentation.
Once you have requested dates, your booking confirmation will be received within 48hrs, confirming your stay. If the booking confirmation hasn’t been received within the advised time, it is the members responsibility to contact The Peaks directly.
VAT and taxes may be applicable when it comes to payment and can change at any time depending on the hotel/country.

Additional Terms

Members are responsible for ensuring they are aligned with all immigration/visa/health requirements in relation to the country in which the hotel is situated.
Special requests (dietary requirements, room location, children requirements etc) should be shared at the time of booking. If requirements are not met, The Peaks holds no responsibility/is not liable.
Travel insurance will be the responsibility of the member and no other parties (including The Peaks and the hotel partner).
The Peaks will ensure that all the information is accurate. Occasionally changes and errors occur and The Peaks reserve the right to correct prices and other details in such circumstances.
Eventually, each hotel will be available for ratings by other members (only once they have stayed there). These are intended as guides. Please note, standards and ratings might vary between countries.
If you or a person you are travelling with has any disabilities or medical issues, please provide details upon booking and The Peaks/hotel will do our upmost to ensure your stay is comfortable. It is the member’s responsibility to provide relevant and accurate information. In relation to complimentary experiences, doctor’s notes may need to be given in certain circumstances.
Members are expected to conduct themselves properly and not disrupt other guest’s experiences. If the hotel decides your behaviour is not appropriate, hotel’s reserve the right to cancel the rest of member’s stay. The Peaks will not be held responsible for these occurrences.
If members break/damage hotel property, it is at the discretion of the hotel to charge the member. The Peaks will not be held responsible for these occurrences.
If any partner refuses to honour the offer, please contact us.
Unauthorised reproduction, resale or modification of any The Peaks offers is prohibited.
Those holding an individual membership for The Peaks will be able to book a room for themselves plus one (only applicable when sharing a room). Two separate rooms will not be bookable through one individual Peaks membership.

T&Cs for Sneak Peaks

All bookings are subject to availability.
Full deposit non-refundable prepayment required at the time of booking.
‘Sneak Peaks’ offers may be subject to blackout dates which may be amended by the hotel at any time and which may not be specified on our website.
Minimum two consecutive nights.
The rate may be subject to service charges and government tax depending on the location.
The above benefits may not be used in conjunction with any other discount or exchanged for any other service or cash.
The rate quoted is per room, per night, including maximum discount, and is subject to seasonal variations, a cancellation policy and change without notice. Rate noted above is based on recent currency exchange data. The rate indicated on your confirmation is in the official hotel currency and will be charged at that rate on check-out.
Any special terms will be stated on the booking and included in your confirmation.
Reservations made before the start of the offer or promotion cannot be cancelled and rebooked at the lower rate.
Please note that complimentary experiences may not always be applicable when booking Sneak Peak offers. If it does apply it will be stated in the text of the offer.
